Terms of Use

1. Scope

These Terms apply to the use of "EMBER" (the "App") and form the entire agreement between you and the operator. By using the App you agree to these Terms.

2. About the App

EMBER lets you spend time with a small companion that grows as you keep daily habits. It includes habit logging, companion growth, room decoration and notifications. No account is required. The operator may change the App's features at any time without notice.

3. Age and parental consent

If you are a minor, please get a parent or guardian's consent before using paid features.

4. Pricing, auto-renewal and cancellation

The basic features are free.

"Plus" is an auto-renewing subscription, offered monthly or yearly at the price (tax included) shown on the purchase screen. New subscribers may be offered a free trial; its length is shown on the purchase screen.

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your account will be charged for renewal.
• You can manage or cancel your subscription any time in iPhone Settings → Apple ID → Subscriptions.
• If you cancel during a free trial, you will not be charged.
• Refunds are handled by Apple under its policies.

You can restore purchases with "Restore Purchases" on the same Apple ID.

5. Your data

App data (names, habits, records, settings) is stored on your device and is not sent to the operator's servers. Deleting the App or resetting your device removes the data; it may be restored from your device backup (such as iCloud). The operator is not responsible for data loss.

6. Prohibited acts

You must not: violate laws or public order; reverse engineer or tamper with the App; place excessive load on the App or related services; or infringe the rights of the operator or third parties.

7. Intellectual property

All rights in the App's name, logo, characters, images and text belong to the operator or the rightful owners.

8. Disclaimer

The App is provided "as is". The operator does not guarantee that you will form habits or achieve any specific result, and the App is not medical or health advice. The companion's condition (e.g., becoming weak or returning to the stars) is an in-app presentation.

Except in cases of intent or gross negligence, the operator is not liable for damages arising from use of the App, subject to mandatory consumer protection laws.

9. Changes and termination

The operator may change, suspend or end the App in whole or in part. Important changes will be announced in the App.

10. Changes to these Terms

The operator may update these Terms. Important changes will be announced in the App. Continued use after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute.

The operator's name and address are disclosed without delay upon request.
